1. Definitions
1.1 The following definitions apply to these terms and conditions governing the contract of services between you and us.
1.2 “Us”, “we”, “our” and “Hotshots” means Hotshots Australia Pty Ltd, its affiliates, subsidiaries, and its independent contractors, employees, and agents.
1.3 “Carrier” means any third-party transport company or air transport provider engaged by us.
1.4 “Goods”, “items” and “shipment” means any items of any nature that we have accepted and transported by Hotshots Australia.
1.5 “You”, “your” and “consignor” means the sender, consignor, consignee of the shipment, receiver, owner of the goods, holder of a consignment note, or any other party with a legal interest in the transported goods.
1.6 “Carriage” refers to the entirety of the services undertaken by us in relation to the transportation of the goods.
1.7 “App” or “Portal” refers to the Hotshots Australia Driver Portal and Customer Portal, accessible via hotshotsaustralia.com.au/portal/ or any linked web address we provide.
1.8 “ePOD” or “Proof of Delivery” means the electronic proof of delivery record generated upon completion of a delivery, which may include a delivery photograph, recipient signature or printed name, GPS-recorded delivery location, and server-generated timestamp.
1.9 “Con Note” or “Consignment Note” means the electronic document generated for each consignment, recording shipment details, parties, and delivery outcome.
2. Acceptance of Terms and Conditions
2.1 By using Hotshots Australia to transport your goods, you accept these terms and conditions on behalf of yourself and/or any other party with an interest in the shipment or services, irrespective of whether you have signed a consignment, contract, or any other document.
2.2 By using the Hotshots Australia customer portal or receiving automated notifications from us, you also accept these terms and conditions as they relate to the use of those digital services.
2.3 If you provide us with instructions that conflict with these terms and conditions, we will not be bound by such instructions.
3. Prohibited Items
3.1 You certify that no prohibited or illegal goods are contained within the shipment. A full description of the goods must be provided before transport commences.
4. Road Transport and Air Freight Regulations
4.1 You agree that all goods transported meet safety and security regulations set out by relevant government departments or agencies.
4.2 You agree that upon request, your packages may be opened and searched at any time.
5. Liability
5.1 You agree we are not liable for: any loss of profits, income, reputation, customers, use, opportunity, or markets arising from any indirect, incidental, or consequential loss or damage; situations beyond our control such as force majeure, local disruptions, or transport disruptions; or your omissions or those of third parties.
5.2 You agree not to permit any other person with an interest in the shipment to bring a claim or action against us.
5.3 Our liability for any single claim in connection with a consignment is limited to the lesser of the documented value of the goods or the amount agreed in writing prior to dispatch, unless a higher declared value has been confirmed by Hotshots Australia before transport commences.
6. Claims Procedure
6.1 To make a claim for damaged, lost, or delayed shipments, you must: notify us in writing within 7 days after delivery; provide all relevant details and photographs where necessary; settle our charges before we act on any claim; and make the damaged contents and original packaging available for inspection.
6.2 No claim will be accepted more than 60 days after the recorded delivery date as shown in our electronic proof of delivery system.
7. Delays
7.1 Any delays exceeding 30 minutes during pick-up and delivery will incur a minimum charge of 30 minutes and a continual charge per 30 minutes thereafter, billed at the current hourly rate.
7.2 You are responsible for providing accurate and complete pick-up and delivery addresses and contact information. We accept no liability for failed, delayed, or misdirected deliveries resulting from inaccurate or incomplete information provided by you.
8. Payment for Service
8.1 Payment must be made before or upon delivery unless a credit account is held with us. Credit accounts must be paid within 7 days from the invoice date.
9. Electronic Proof of Delivery and Digital Records
9.1 Legal validity of ePOD. Upon delivery of your goods, our driver will complete an electronic proof of delivery (ePOD) record. This may include a photograph of the delivered goods and/or delivery location, a recipient’s printed name entered electronically, a recipient’s electronic signature, a GPS-recorded delivery location, and a server-generated timestamp.
9.2 Acceptance of ePOD. By accepting delivery of goods, or by providing a printed name, signature, or any form of acknowledgement via a device presented by a Hotshots Australia driver or via the customer portal, you acknowledge receipt of the specified goods and confirm delivery has been completed. Electronic signatures and printed names provided in this manner constitute legally valid proof of delivery under the Electronic Transactions Act 1999 (Cth) and its state equivalents, and are binding to the same extent as a handwritten signature.
9.3 Conclusive evidence. The ePOD record, including the delivery photograph, GPS coordinates, timestamp, and recipient acknowledgement, shall be accepted as conclusive evidence of delivery unless written dispute is lodged with Hotshots Australia within 14 days of the recorded delivery date.
9.4 Record retention. Delivery records, consignment notes, and ePOD documents are retained for a minimum of 6 years from the date of delivery.
9.5 Con notes. Consignment notes are generated and stored digitally. A copy of any con note associated with your shipment is available on request or through the customer portal.
10. Customer Portal — Access and Responsibilities
10.1 Portal access. We may provide you with access to the Hotshots Australia customer portal, which allows you to view consignment notes, delivery records, and proof of delivery documents related to your shipments.
10.2 Account security. You are responsible for maintaining the confidentiality of your login credentials. Hotshots Australia accepts no liability for unauthorised access to your account where such access results from a failure on your part to maintain credential security.
10.3 Accuracy of information. You are responsible for ensuring that all contact details, delivery addresses, and other information provided to us or entered into the portal are accurate and up to date.
10.4 Availability. We will make reasonable efforts to ensure the portal is available and functional, but we do not guarantee uninterrupted or error-free access. We may suspend or modify portal access for maintenance or operational reasons without notice.
11. Automated Notifications
11.1 By providing your email address in connection with a consignment, you consent to receiving automated transactional notifications from Hotshots Australia, including estimated time of arrival (ETA) notifications and proof of delivery confirmations.
11.2 These notifications are sent via Brevo (Sendinblue SAS, France). Your name and email address are processed by Brevo solely for the purpose of delivering these notifications. See our Privacy Policy for further information.
11.3 You may opt out of future notifications by contacting brenton@hotshotsaustralia.com.au, however this may affect our ability to provide real-time delivery updates and documentation to you.
12. Delivery Photographs
12.1 Our drivers photograph goods at pickup and delivery as part of our standard service. These photographs are taken for delivery verification, quality assurance, and dispute resolution; are retained as part of the ePOD record for a minimum of 6 years; are accessible to the relevant customer via the portal or on written request; and are not shared with third parties except as described in our Privacy Policy.
12.2 By using our services, you acknowledge and consent to the taking of delivery photographs at pickup and delivery locations associated with your consignment.
13. Governing Law
13.1 These terms and conditions are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
14. Interaction with Contractor Drivers
14.1 Customers must not directly contact our contractor drivers for any work-related matters. All communication regarding the transport and delivery of goods must be conducted through Hotshots Australia.
14.2 We are not liable for any issues arising from direct communication between customers and our contractor drivers outside of the Hotshots Australia system.
15. Changes to These Terms
15.1 We may update these terms and conditions from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of our services following any update constitutes acceptance of the revised terms.
